This Agreement defines the procedure for processing and protection by FlyWert MyBestdate (hereinafter referred to as the Company) of information about individuals (hereinafter referred to as Users), which can be received by the Company when the User fills out the registration form, as well as the procedure and consent of the User to receive advertising information.
1.Subject-matter of the agreement
1.1. The purpose of this Agreement is to ensure proper protection of information about Users, including their personal data, from unauthorized access and disclosure, compliance with advertising legislation, including when the User receives advertising information.
1.2. The processing of the User's personal data is carried out within the period necessary for the purposes specified in this Agreement, in any legal way, including in information systems using automation tools or without using such tools.
1.3. When exchanging information, the Parties undertake to comply with the requirements of the Law "On Personal Data".
1.4. The Company guarantees that the transfer of Personal Data is carried out with the consent of each Personal Data entity to the processing of his Personal Data.
1.5. The Parties ensure the confidentiality of Personal Data and security during their processing.
1.6. Personal data authorized for processing under this Privacy Policy is provided by the
User by filling out the registration form and includes the following information:
– full name of the User;
– User's phone number;
– E-Mail;
By filling out the registration form, the User expresses his full consent to the terms of
this Policy. By clicking "Submit", the User agrees to the processing and transfer of his
personal data to the Company, left when filling out the registration form, in order to
receive advertising information. The User also agrees to receive advertising information
from the Company through any communication channels provided by the User when
filling out the registration form.
2. Obligations of the Parties
2.1. When processing Personal Data, the Parties are obliged to take the necessary legal, organizational and technical measures or ensure their adoption to protect personal data from unauthorized or accidental access to them, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other illegal actions regarding personal data.
2.2. Ensuring the security of Personal Data is achieved, in particular by
1. determination of threats to the security of personal data during their
processing in information systems of personal data;
2. application of organizational and technical measures to ensure the security of
personal data during their processing in information systems of personal data
necessary to fulfill the requirements for the protection of personal data;
3. the use of information security tools that have passed the conformity
assessment procedure in accordance with the established procedure;
4. evaluation of the effectiveness of measures taken to ensure the security of
personal data before the commissioning of the personal data information
system;
5. taking into account personal data on computer-readable forms’;
6. detection of facts of unauthorized access to personal data and taking
measures, including measures to detect, prevent and eliminate the
consequences of computer attacks on personal data information systems and
to respond to computer incidents in them;
7. restoration of personal data modified or destroyed due to unauthorized access
to them;
8. establishing rules for access to personal data processed in the personal data
information system, as well as ensuring the registration and accounting of all
actions performed with personal data in the personal data information system;
9. control over the measures taken to ensure the security of personal data and
the level of security of personal data information systems.
3. Responsibility of the Parties
3.1. The Parties are responsible for non-fulfillment or improper fulfillment of this Agreement in accordance with the legislation of the Republic of Estonia.
3.2. The Company takes the necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions of third parties.
3.3. When filling out the registration form, the User confirms that: indicates reliable information about himself, all other information is provided by the User at his own discretion; is familiar with this Agreement, expresses his consent to it. Familiarization with the terms of this Agreement and putting a tick under the link to this Agreement is the written consent of the User to the collection, storage, processing of personal data provided by the User.
4. Final Clauses
4.1. The Company has the right to amend this Agreement. When making changes in the current version, the date of the last update is indicated. The new version of the Agreement comes into force from the moment it is posted, unless otherwise provided by the new version of the Agreement.
4.2. The relations of the Parties not regulated by this Agreement are regulated by the current legislation of the Republic of Estonia.
4.3. Before going to court with a claim on disputes arising from the relationship between the User and the Company, it is mandatory to comply with the claim procedure for regulating the dispute.
4.4. The Parties are not allowed to transfer their rights and obligations under this Agreement to third parties without the written consent of the other Party.
4.5. The Company does not verify the accuracy of the information received (collected) about Users, except in cases when such verification is necessary in order to fulfill obligations to the User.
5.Prohibition on obtaining personal data
To prohibit the Company from receiving personal information from the site Facebook.com , it is necessary to follow the link https://www.facebook.com/settings?tab=applications and remove the site from the list of apps.
